One for the rule-book officianados.
Brad Mosen won the Midget 40 lapper at Western Springs under controversial circumstances. After initially being deemed the cause of an incident, Mosen was sent to the rear. It has been reported that Mosen then ran under protest from the front of the field. The rule is as follows:
"If a competitor is excluded from a race prior to its start, in a series of heats, or during a red light stoppage, he may continue to race under protest if there is an element of doubt about his exclusion, and this is agreed to by the Steward or Referee. The decision to exclude or not exclude that competitor will be made immediately after the race in question"
As the rule reads it only applies to heat races, red lights or prior to the start of a race. Not feature events. This is further backed up by one of the rules under heats.
"Only those competitors qualified in their heats, shall take part in the semi-finals and only those competitors qualified in the semi-finals shall take part in the final"
A feature race can't be deemed to be a heat given this rule.
Summation - The protest rule does not appear to apply to a feature race.
As a side note, "Promoters Choice" entrants in feature races also appear dubious unless local rule procedures are followed.
In the confusion surrounding the incident Mosen drove infield as he thought he was ordered off. A rule under race in progress reads as follows:
"Any competitor who has proceeded to the infield and stopped shall be deemed to have retired"
It is important to note the race in progress rules do cover yellow flag periods as other rules under this title deal with outside assistance (with the exception of a push start under certain circumstances).
Summation - Mosen retired from the race by driving infield and stopping
So folks, I put it to you all that Brad Mosen was a very lucky man in being presented as winner of the 40 lap King of the Springs feature.
